The Immigration and Naturalization
Service (INS) oversees the immigration of foreign nationals to the United States. Foreign nationals seeking entry into are grouped
into two broad categories: "immigrants" and
"non-immigrants".
Immigrants
are those seeking to reside in the United
States permanently. The document that signifies that the holder has obtained permanent resident status is commonly referred to as a "green card".
Those classified as non-immigrants all those who enter the United States with visas or on a temporary basis.
There are several different classifications of visas available to foreign nationals. Visas of
particular interest for non-immigrant professionals and business
executives include: Treaty (Investor/Trader) Visas (E
visas); Intra-company
Transferees (L
visas), Aliens of Extraordinary Ability (O
visas);
Artists and Athletes (P
visas); and Canadian & Mexican
Professionals (TN
visas).
Immigrant applicants considered for
United States immigration under a quota system are divided into
three subgroups:
- Family-sponsored immigrants
- Employment-sponsored immigrants
- Diversity Lottery Immigrants
Immigrant status is allowed without regard to a
quota for the spouse, widow, widower, parents, and unmarried
children under the age of 21 of a United States citizen. Residents of the United States who
return after a period of absence abroad are also eligible for this status.
